I like to poach eggs...they are tasty that way. In Manchester near the public golf course is a body of water, a "reservoir".. water supply perhaps... on one side of it says no trespassing/hunting/fishing. on another side it says no dogs/swimming/boats and above the swimming hole and the "damn spill over" area there is no sign! But there are some really nice pickerel in there but I am paranoid to fish there anymore because of the no fishing/tresspassing signs. Really nice pickerel though....

Hi Boys!

Well .... Have I got a SURPRISE for you to read Exclamation Shocked

Riparian Rights in Ct.

Go to -> www.bpslawyers.com/
Click on "Articles and Publication" under Resources -> Then scroll down to Real Estate/ Land use and click on Riparian Rights.

Oh My! -> Guess what! -> "Landowners Do Own the water" on their land here in Ct. and also the fish in it -> Riparian rights are all based on English common law since the US was founded.

So -> and Get This! -> On top of you trespassing on private land, lakes and ponds -> you can also be charged with "THEFT" for fishing private waters without permission!

Isn't the Internet a wonderful tool to find info on so many subjects! Very Happy

Nice find, i've been trying for a long time to find some sort of law / case law that actually spelled this out one way or another.

I've been going on "hearsay", but from what i thought were reliable sources (elected town officials, and a state trooper) but apparently they were wrong lol.

Hi phs,

NO! ...People just don't know what the law is. (Or don't care Evil or Very Mad )

Which is why it's always best to ask or go find out the answer(s).

As they will tell you in court -> Ignorance of the law is No Excuse Exclamation

That's not always true, Stephen. It depends on whether the water is "navigable". Here's an old thread in which this was discussed:

That's simply not true in my experience, Joe. I've had good luck when asking permission. I was told, "No", only once by a guy who had said, "Yes", once before. In fact, when he said, "Yes", he said he was surprised that I had even asked and thanked me for doing so. Man up and ask the next time you want to check out a pond that you think is privately owned. Wink There are so many great places to fish in Connecticut that I wouldn't want to fish where a property owner had a valid objection.

Third: Where are you, setterman? What brought this up in the first place, anyway? Question

Hi Phil,

Yeah! That question about what is considered navigable or non navigable waters is something that hasn't really been put to the test here in Ct.

Don't think it ever will be either -> But your right that navigable waters per se are those that have been designated with the ability to carry commerce.

Wouldn't expect any changes in the near future -> Private waters are private and that's the way it is!

We know that when we fished T lake! -> Always best to ask for permission -> Nothing like getting off on the right foot! Very Happy

I forgot about that one, Stephen. I've been granted permission to traverse a private landowner's property to fish four out of five times. Very Happy

Looking forward to tommorrow and Friday -> Finally Mother Nature is co-operating! Very Happy

"to whomever the soil belongs, he owns also to the sky and to the depths."

Guess that also means, I can be charged for breathing "their" air, or a plane flying overhead in "their" airspace can be charged with trespassing too?

The laws quite a joke in my opinion. . .

CtBassman,, Are you looking to get a stupid ticket for trespassing or are you just stupid,, respect what signs say,,if it says no trespassing then dont do it,, if there is a public body of water, that leads to it,, then yes you can UNLESS there is a sign at the entrance that says no trespassing,, there are plenty of places to fish legally,, Most true sportsman obide by what is posted,, its the dumbasses that cant read that get fined,,or fired at,,if you cant catch good fish in a local pond that is known to have good fish,,, then YOU SUCK,, plain and simple

Thats a little harsh of a statement. Did I say I walk thru peoples backyards to get to spots? No I didn't. But if theres public land that I can walk on to get to a body of water that I want to fish, then yes, I will do it, judge me for whatever it is.

Hey flippy and all other good members of CTFT,

Don't wast anymore time on CT_Bassman.

We all know now what kind of individual he is, "by his own words he admitted he will try to gain access to private waters without permission", with no respect for the law or rights of the land/water owner.

Gentlemen and Ladies! -> CT_Bassman has proven he is no sportsman with any integrity!
He just doesn't get it, that what he advocates is.... so very WRONG!.... So further dialogue with him is wasting your breath or beating a dead horse Exclamation

My personal opinion is not to bother with him !.....Or as they say -> Birds of a feather will flock together -> (Trespassers, Law Breakers, Dishonest/Disrespectful Sportsmen, etc.)
Not the kind of individual, with such Low Personal Ethics, I would care to associate with!
